Terms of Service

These Terms of Service (“Terms”) govern the use of the website globeclaim.io (“the Platform”) and any services provided through it, operated by:

“User” refers to any individual using the Platform. “Tile” refers to a digital territory unit on the GlobeClaim globe. “Territory” refers to a group of adjacent Tiles owned by a User. By using this Platform, you agree to these Terms.

GlobeClaim is an interactive digital platform where users can claim virtual territories on a 3D globe, associate them with projects, and build a public presence. The Platform provides:

• A 3D interactive globe divided into claimable tiles
• User accounts with profile and reputation systems
• Free and paid tile claiming options
• Territory management and public project pages

To claim tiles and use interactive features, you must create an account via a supported OAuth provider (GitHub, Google, or Discord). You agree to:

• Provide accurate and truthful account information
• Keep your login credentials secure and confidential
• Not create multiple accounts (“alt accounts”, “sock puppets”) for any purpose, including circumventing limits, bans, or restrictions
• Not impersonate other individuals, organizations, or entities
• Not use temporary, disposable, or fraudulently obtained email addresses
• Not register accounts via automated means (bots, scripts, browser automation)
• Not sell, transfer, or share account access with third parties

3.1 One Account Per Person (Strict Policy)

Each natural person is permitted exactly one account. Operating multiple accounts is strictly prohibited regardless of the method used (different emails, different OAuth providers, VPNs, proxies, etc.). If the Operator reasonably determines that a User operates multiple accounts, all associated accounts may be permanently suspended without refund and all claimed tiles may be forfeited.

3.2 Public Visibility

Your profile information (display name, handle, profile picture) and all tile content you submit (project name, description, URL, category) are publicly visible to all visitors of the Platform. Reputation scores, rank titles, and territory information are also publicly displayed. By using the Platform, you acknowledge and consent to this public visibility.

3.3 Account Deletion

You may request the deletion of your account and all associated data at any time. Account deletion can be initiated directly from your account settings or by contacting us at [email protected]. Upon deletion, all your tiles, territories, reputation data, and personal information will be permanently removed. This action is irreversible. Payment records may be retained as required by applicable tax law (see our Privacy Policy).

3.4 Account Suspension & Termination

The Operator reserves the right to immediately suspend or permanently terminate any account that:

• Violates any provision of these Terms
• Is reasonably determined to be a duplicate, fake, or fraudulent account
• Was created or operated by automated means
• Engages in abusive, disruptive, or manipulative behavior
• Is associated with any form of spam, scam, or fraudulent activity

Suspended accounts lose access to all tiles, territories, and associated data. In case of justified termination due to a violation of these Terms, paid tiles will not be refunded unless otherwise required by applicable consumer protection law.

3.5 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Platform. By registering, you confirm that you meet this age requirement. The Operator does not knowingly collect data from minors.

4.1 Nature of Claims

Claiming a tile on GlobeClaim grants you a digital license to associate your project with that tile on the Platform. Tile claims do not constitute ownership of real property, intellectual property rights beyond the Platform, or any form of investment or financial instrument.

4.2 Free Tiles

A limited number of tiles are available for free claiming. Free tiles are subject to the same Terms as paid tiles. The Operator reserves the right to limit, modify, or discontinue the free tier at any time.

4.3 Paid Tiles

Premium tiles may be purchased via Stripe or PayPal. Prices are displayed before checkout. Refunds are excluded unless required by applicable consumer protection law (see Section 8 for your EU right of withdrawal).

4.4 Content Policy

GlobeClaim is a clean, professional platform. All content must be suitable for a general audience. Projects associated with claimed tiles must not contain, link to, or promote:

• Pornography & NSFW content — No adult, sexually explicit, or suggestive material of any kind
• Gambling & casinos — Online gambling, sports betting, or casino-related content may be restricted
• Scams & phishing — No deceptive, fraudulent, or misleading content
• Piracy & warez — No copyright-infringing material, cracked software, or torrent sites
• Illegal content — No drugs, weapons, or any content violating applicable law
• Hate speech & extremism — No content promoting violence, discrimination, or extremist ideologies
• Malware — No malicious code, exploits, or harmful downloads
• Trademark violations — No unauthorized use of third-party brands, logos, or intellectual property
• Spam & manipulation — No mass-created, low-quality, or bot-generated content

All submitted content is subject to automated screening and community reporting. Content that violates these guidelines will be placed under review and may be removed without prior notice. Repeat or severe violations may result in account suspension. Refunds for paid tiles are excluded in case of justified content policy enforcement, unless otherwise required by applicable consumer protection law.

Users can report violations using the “Report” function available on every tile page. The Operator reviews all reports and reserves the right to take immediate action.

4.5 Visual Representation & Display

The visual presentation of tiles on the globe (including but not limited to size, color, glow effects, animation, prominence, and positioning) may vary based on factors such as tile tier (free or paid), activity level, reputation score, territory size, or other platform metrics. Paid tiles and tiles with higher engagement may receive enhanced visual prominence on the globe. The Operator reserves the right to adjust, modify, or redesign the visual representation of any or all tiles at any time without prior notice. These visual differences are part of the Platform's design and do not constitute a guarantee of specific visibility, traffic, or exposure.

When using the Platform, you agree to:

• Use the Platform only for lawful purposes
• Not attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Not transmit malicious code, spam, or harmful content
• Not manipulate reputation scores or gaming mechanics
• Not resell or commercially exploit tile claims outside the Platform

5.1 Automation & Bot Prohibition

The following automated activities are strictly prohibited:

• Using bots, scripts, browser automation (Selenium, Puppeteer, etc.) to create accounts or claim tiles
• Using automated tools to scrape, crawl, or extract data from the Platform beyond normal usage
• Mass-creating tiles or accounts through any automated or semi-automated process
• Circumventing security measures including CAPTCHA/challenge verification (Cloudflare Turnstile)
• Using proxies, VPNs, or other tools to disguise identity for the purpose of creating multiple accounts or evading bans

5.2 Mass-Claiming & Territory Abuse

Users must not engage in coordinated or systematic mass-claiming of tiles, whether individually or through collusion with other users. Claiming tiles with no genuine project intent (“tile squatting”) or for the sole purpose of blocking others is prohibited. The Operator reserves the right to reclaim tiles that appear to be squatted, spammed, or abused.

5.3 Search Engine Manipulation

Using GlobeClaim tiles to artificially inflate search engine rankings (SEO spam), create doorway pages, index prohibited content, or engage in link farming is strictly prohibited. Tiles used for search engine manipulation will be removed and the associated accounts permanently banned.

6.1 Platform Content

All content on this Platform (code, design, graphics, logos, 3D assets, animations) is the property of the Operator and protected by German and international copyright law. Unauthorized reproduction or distribution is prohibited.

6.2 User Content

You retain ownership of any content you submit (project names, descriptions, URLs). By submitting content, you grant the Operator a worldwide, non-exclusive, royalty-free license to display it on the Platform as part of the service.

Payments are processed via Stripe (credit/debit card) and PayPal. All prices are in US Dollars ($) and include applicable VAT where required. By completing a purchase, you agree to the respective payment provider's terms: Stripe Terms · PayPal User Agreement.

The Operator does not store payment card information or bank details. All payment data is handled exclusively by the respective payment processor. See our Privacy Policy for details.

If you are a consumer within the EU, you have a 14-day right of withdrawal under the EU Consumer Rights Directive. However, by purchasing a digital tile and explicitly consenting to immediate performance, you acknowledge that you lose your right of withdrawal once the digital content has been delivered (§356(5) BGB).

To exercise the right of withdrawal (where applicable), send a clear written statement to [email protected] within 14 days of purchase.

The Platform is provided “as is” and “as available.” The Operator makes no warranties regarding uninterrupted availability, error-free operation, or data persistence.

The Operator's liability is limited to intent and gross negligence. For slight negligence, liability is limited to foreseeable, typically occurring damages and only in case of breach of material contractual obligations. This does not affect liability for injury to life, body, or health, or mandatory liability under German product liability law.

We strive for high availability but do not guarantee uninterrupted access. The Operator reserves the right to modify, suspend, or discontinue features of the Platform at any time. In case of permanent discontinuation, reasonable notice will be provided.

Personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, mandatory consumer protection laws of your country of residence apply additionally. The place of jurisdiction is Hamburg, Germany, for merchants and entities.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that achieves the original economic purpose as closely as possible.

We may update these Terms from time to time. Material changes will be communicated via the Platform. Continued use after changes constitutes acceptance. The date at the top indicates the latest revision.
